What kind of damages are available under Florida personal injury law?

Four types of personal damages are possible:

  • Economic damages: Medical bills, lost wages, etc.

How long will it take to resolve my claim?

Although this is an impossible question to answer with any precision without knowing the facts of your case, most claims are resolved in a few weeks to a few months. Some claims, however, do drag on longer than that. The larger the amount in controversy, the longer it generally takes to resolve the claim. Medical malpractice claims tend to take longer to resolve than other cases.

Can I sue the federal government, the state of Florida, or a local government for personal injury?

Sometimes you can. Governments enjoy sovereign immunity, which allows them to limit the power to sue them for money damages (since the damages would come out of taxpayer money). Governments have waived their sovereign immunity for most personal injury claims, however.  Nevertheless, they have imposed certain restrictions on filing deadlines and the maximum amount of damages awardable.

Can I file a personal injury claim against a nursing home for neglecting my loved one?

Yes, you can file a claim on behalf of your loved one. Nursing home neglect is definitely considered a form of abuse, even if it is passive in nature (failure to treat bedsores, for example). Your claim will be especially strong if you can point to a violation of nursing home regulations that harmed your loved one.

Can I file a claim against a nightclub that served alcohol to a drunk driver who later caused the accident that injured me?

You might be able to file a claim under the Florida dram shop law. The nightclub could be liable if the driver was:

  • under 21; or
  • “habitually addicted” to alcohol

The nightclub would only be liable if the nightclub knew or should have known that the driver was underage or habitually addicted to alcohol.
