Will I have to sell all my property if I file for bankruptcy?

Not necessarily. If you file for Chapter 13, you may not have to part with any of it. Even if you file for Chapter 7, it is likely that you will be able to keep some of your property by taking advantage of Florida's bankruptcy exemptions, which are among the nation's most generous. These exemptions include:

  • Your personal residence (within certain limits).
  • A certain amount of personal property.
  • Some insurance and pension benefits.
  • Public assistance benefits, including social security and unemployment.

Certain other property may be exempt as well.

Are student loans dischargeable in bankruptcy?

Usually not. There is an exception: student loans are dischargeable if the debtor can prove that repayment would result in an “undue hardship.”  Such a discharge is not easy to qualify for. It is not impossible, however, at least with the assistance of an experienced Arcadia bankruptcy lawyer.
