What Happens to My Vehicle If I File Chapter 13 Bankruptcy??

A concern for many people needing to file bankruptcy is what do I do about a vehicle.  There are more options than you might think.  I previously wrote about vehicle options in chapter 7.  This blog will focus on vehicle options in chapter 13.

First, I will discuss cases where the Debtor's vehicle has a vehicle loan.  A vehicle loan is a secured debt.  When you file chapter 13, you must file a chapter 13 plan advising the court and the creditor of your intentions regarding the debt secured by the vehicle.  The options include pay direct, pay in plan with or without curing arrears, value, or surrender.

If you choose to pay the vehicle loan direct, you will continue to make the payments as you were before you filed bankruptcy directly to the creditor.  This is a good option for people that have a decent interest rate and do not owe more than the vehicle's value.  You must be current on the payments to choose this option.  If you are not current on the payments, you must pay the loan through the chapter 13 plan. 

There are a few reasons people choose to pay a vehicle loan in the chapter 13 plan. Paying the vehicle loan in the plan means the payment will be included in the chapter 13 payment made to the trustee.  If you have a high interest rate, it may benefit you to pay the plan because the court provides the interest rate to be paid in the plan, which is called the till rate.  This rate is prime plus 2 percent.  Currently, the prime interest rate is 7 percent. 

If you are behind in your payments on your vehicle loan, you are limited to either curing the arrears and paying the ongoing payments in the plan or surrendering the vehicle to the creditor.  The payment will be recalculated to pay the till interest rate on the balance of the loan over the life of your chapter 13 plan.

Finally, you have the option of surrendering the vehicle back to the creditor in a chapter 13 as well.  There are programs that we can refer you to that can get you a new vehicle even if you have to file chapter 13.  This is usually a good option for someone that has a vehicle that needs repairs it is just not feasible to keep paying on the vehicle.

Una preocupación de muchas personas con la necesidad de presentar una petición de Bancarrota es lo que se debe hacer con un vehículo. Hay más opciones de las que puede pensar. Previamente escribí acerca de las opciones de un vehículo en una Bancarrota del Capitulo 7. Esta bitácora se enfocará en las opciones de un vehículo en una Bancarrota del Capítulo 13.

Primero, discutiré casos donde el vehículo del Deudor está siendo financiado, es decir, está bajo un préstamo de auto. Este tipo de préstamo es una deuda garantizada. Cuando un Deudor presenta una Bancarrota del Capítulo 7, debe presentar un “plan del Capítulo 13” informando a la corte y al acreedor sus intenciones con la deuda garantizada por el vehículo. Las opciones incluyen el pago directo, el pago en el plan con o sin curar los pagos atrasados, el valor, o la entrega voluntaria.

Si usted elige pagar el préstamo directamente, deberá de continuar haciendo los pagos directamente al acreedor de la misma manera en la que hacía los pagos antes de presentar la petición de Bancarrota. Esta es una buena opción para las personas que tienen una tasa de interés decente y no deben más que el valor del vehículo. Usted debe de estar al corriente con los pagos para poder elegir esta opción. Si no esta al corriente con los pagos, usted deberá de pagar el préstamo en el plan del Capítulo 13.

Hay unas cuantas razones por las que Deudores eligen pagar el préstamo del vehículo en el plan del Capitulo 13. Pagar el préstamo del vehículo en el plan significa que el pago estará incluido en el pago al fideicomisario del plan del Capitulo 13. Si usted tiene una tasa de interés alta, podría ser beneficioso el pagar bajo el plan, ya que la corte provee el interés que debe ser pagado en el plan, el cual es llamado el “till rate.” Esta tasa es la tasa preferencial mas el 2%. Actualmente, la tasa preferencial es 7%.

Si usted esta atrasado en los pagos del préstamo de su vehículo, esta limitado a curar el atraso y realizar los pagos futuros en el plan o entregar voluntariamente el vehículo al acreedor. El pago será recalculado para pagar el interés “till” del balance del préstamo durante el término de su plan del Capítulo 13.

Finalmente, usted tiene la opción de entregar voluntariamente el vehículo al acreedor. Hay programas a los que podemos referirlo para que obtenga un nuevo vehículo así tenga que presentar una petición de Bancarrota del Capitulo 13. Esta opción es usualmente buena para personas que tienen un vehículo que necesita reparos y no es factible continuar realizando pagos en el vehículo.
