Important: Credit Report Accuracy

Posted by Ryan Singleton | Jun 23, 2022

The accuracy of a credit report can have a tremendous impact on a person's financial well-being.  We frequently receive complaints from clients regarding an inability to secure financing to purchase a home due to an error on their credit report.

We assist our clients in submitting disputes to the credit bureaus, which is the most effective way to remove an error.  In most cases, the credit report will be properly updated within 30 days of the dispute.  If the dispute is not properly addressed by the credit bureaus or the creditor within the 30-day deadline, then our firm would pursue a possible violation of the Fair Credit Reporting Act (FCRA).

The easiest method to dispute an error on your credit report is to submit online disputes to each of the credit bureaus separately. For instance, with Experian, you can go to https://www.experian.com/disputes/main.html and click "Start a new dispute online." It will ask you for your personal details and give you the opportunity to upload documents in support of your dispute. Same with TransUnion: https://www.transunion.com/credit-disputes/dispute-your-credit. And with Equifax: https://www.equifax.com/personal/credit-report-services/credit-dispute/

Please note that their online dispute forms don't capture or save what you write in them, which sometimes makes it difficult to prove that a violation occurred. For that reason, we recommend submitting a letter of explanation regarding the underlying facts, which you should keep for your own records.  You should also attach all documentation which might prove that the information in question is erroneous.

In cases of a FCRA violation, consumers can retain an attorney for free.  This is because the FRCA requires the creditors to pay for a consumer's attorney's fees on top of the awarded damages. Of course, they are also required to correct the credit reporting error as well.
